How Chapter 7 Works

Once you have met with me for an initial consultation, you will be asked to collect a number of documents and complete a questionnaire.  Upon completion and return of the information to my office, your next task will be to complete an online credit counseling course.

My office recommends using Cricket Credit Counseling, which can be found at cricketdebt.com. This credit counseling course can also be taken prior to meeting with me.  Please use attorney code 410001.  Upon completion of the petition and schedules by me, you will be contacted for another meeting to review the petition and schedules for accuracy, signing, and collection of attorney and filing fees.

Approximately one month after filing, you will be required to attend a hearing in front of a bankruptcy trustee, referred to as the meeting of the creditors or 341 hearing.   The purpose of the hearing is for the trustee to determine what assets are non-exempt and available to be used for payment to creditors.  The anticipated length of the hearing is 10 minutes.

Within 60 days after the meeting of the creditors, you will be required to complete a financial management instructional course.  This may also be completed at cricketdebt.com. If there are no assets for the trustee to use to pay creditors, your debts will be discharged and your case closed within four months of filing.  If there are sufficient assets, the debts will be discharged within four months but your case may remain open for several months after while the trustee administers the bankruptcy estate.  For more information on Chapter 7 bankruptcy, click here.
